But legal repercussions from those pre-purge days — including federal monitoring and an ever-growing number of lawsuits — are still rippling through Pornhub and its network of user-generated porn sites. It’s been four years since a wave of news accounts revealed that the site was infested with non-consensual videos of rape, sexual assault, child porn, and footage from hidden cameras. But after the women were flown to San Diego from their various home states to make the videos in hotels, the defendants allegedly lied, saying the films would be distributed on DVDs and only to private clients overseas, not on the internet. Nored is accused in the criminal case of acting as a “reference woman” who would lie to the victims by saying she had performed in similar videos that were never posted online. The website and its operators were also sued by 22 women featured in its videos, and a San Diego judge awarded the women nearly $13 million at the end of a civil trial.

Douglas “James” Wiederhold was indicted last month in San Diego federal court on five counts of sex trafficking by force, fraud or coercion, and one count of conspiracy to commit the same alleged crime. He and his co-conspirators are accused of posting internet ads about modeling jobs to lure young women before pressuring and manipulating them into shooting sex tapes. Investigators said they lied to the women, saying that the videos would not be widely disseminated because they were for a private collector overseas and they would remain anonymous. However, Girls Do Porn distributed the videos after they were shot, and they appeared on popular porn websites. In 2019, a Maryland appellate court found 6-1 that child pornography laws apply when a teen is both the subject and sender of sexually explicit media.

GirlsDoPorn is an adult subscription service launched in 2006 by New Zealander Michael Pratt and operated by Ruben Garcia and Matthew Wolfe. Filmed in homes, hotels and trailer parks, videos on GirlsDoPorn specialise in promoting the image of the “ordinary” college girl who is making her first and only pornographic film. After the victims returned home, still believing that they would remain anonymous, Pratt and his co-defendants posted clips of the videos on heavily trafficked adult film sites, like Pornhub, to funnel traffic to the full-length versions of the videos on his website, GirlsDoPorn. Even after severing its partnership with GirlsDoPorn, MindGeek continues to profit from Plaintiffs’ videos to this day. As of December 12, 2020, MindGeek still hosts victims’ videos on its websites, including Plaintiffs.

Once the video productions began, court documents say that some women weren’t allowed to leave the shooting locations until the adult films were completed. Pratt victimized hundreds of young women, federal prosecutors said, including at least one girl under the age of 18. Investigators said that victims were forced into performing nonconsensual sexual acts, and when they wanted their videos removed from the websites, Pratt and his partners threatened and intimidated them.

Because of this knowledge, MindGeek is, at minimum, civilly liable to Plaintiffs under Section 1595 for damages and attorney fees. GirlsDoPorn was using fraud, intimidation, and coercion are part of its regular business practices until the criminal charges were filed in October 2019, MindGeek’s ignorance of the sex trafficking is a direct result of its own negligence, which still triggers Section 1595 liability. Douglas Wiederhold is the latest defendant to plead guilty in the criminal cases against the website’s owners and operators, whom prosecutors say engaged in a years-long sex trafficking conspiracy in which women were coerced and tricked into appearing in pornographic videos under false pretenses.

The women say they were told that the videos would only be available in limited release on DVD, and no one they knew would ever see them. Shortly after they were shot, the videos were posted on the internet, on massively popular websites like Pornhub and YouPorn, and the women were doxed and harassed by viewers using forums like the recently-defunct PornWikiLeaks. During Garcia’s sentencing hearing, the judge heard from 20 victims who described horror stories like being allegedly forced into doing sex scenes and having the videos follow them for years. Meanwhile, the men still face federal charges of sex trafficking and producing child porn.
